A prominent California anti-vaccine group recently posted an image on Instagram falsely claiming that the state has a personal belief exemption for any new vaccine ordered for school-age children.

“Share everywhere because doctors or schools won’t tell you,” the image reads. “California has a personal belief exemption for any new vaccine added to the schedule after June 2015 for public and private child care, preschool, and K-12.”

What Are Tax Exemptions?

The image was posted on June 21 by members of Freedom Angels, an anti-vaccination organization founded by a trio of women in 2019. It falsely refers to California Senate Bill 277, which passed in 2015.

A post by Denise Aguilar, one of the group’s founders, garnered more than 6,500 likes and hundreds of comments. Aguilar also shared the image on a private Telegram channel, where she was seen by almost 2,000 people. Tara Thornton, another founder, shared the image on her page, which got more than 250 likes.

The two women shared the image in Spanish and English. Additionally, the image was shared via a secondary Freedom Angels account, which appears to have multiple Instagram accounts.

Facebook flagged the image as part of its efforts to curb fake news and misinformation in its News Feed. (Read more about PolitiFact California’s partnership with Facebook.) We decided to find out if the claims in the image were accurate.

What Are The Requirements For A Vaccine Medical Exemption?

Senate Bill 277 was introduced after the 2014 Disneyland measles outbreak. Its lead author is state Sen. Richard Pan, a Democrat who represents Sacramento and Yolo counties and is a pediatrician.

The bill eliminates personal belief exemptions for required vaccinations against measles, mumps, rubella, diphtheria, hepatitis B, influenza type B, polio, whooping cough, tetanus and chickenpox.

Until then, California technically required these vaccines for school-age children, but allowed parents to opt out for any reason except personal belief, making it one of the most lenient states in the country when it comes to vaccines. vaccination mandates.

When the law was passed in June 2015, it became one of the strictest vaccination mandates in the country. Without a medical exemption, the only way parents can choose to have their children vaccinated is to homeschool them or enroll them in an independent study program without classroom instruction.

Covid 19 Vaccine Requirement

The move was controversial and drew many anti-vaccination parents in Sacramento to express their anger. Pan and state co-author Sen. Ben Allen (D–Santa Monica) reported receiving death threats while the bill was being debated.

Pan argued that the law would help increase vaccination rates and help prevent outbreaks like the one at Disneyland, which ultimately infected more than 150 people from eight different states, Mexico and Canada.

Four years later, Pan introduced another bill in response to rising medical exemption rates across the state. The bill, which eventually passed, limited medical exemptions by creating a review process that gives public health officials final say on exemptions.

It was accompanied by weeks of protests, some of which were so loud that they brought activity to a halt at the state Capitol building. Critics say the law will close access to exemptions for children who need them and that doctors will be intimidated by the law’s vetting process.

The image says that SB 277 includes a clause establishing personal belief exemptions for any new vaccines required for school-age children.

Currently, the flu, HPV, and COVID-19 vaccines are not required for California students under Senate Bill 277. In fact, the COVID-19 vaccines have not been approved for children under the age of 12 years. Drug manufacturers are currently testing their vaccines in children and results are expected for children ages 5 to 11 by early fall.

Once children’s vaccines are fully approved, it’s unclear whether lawmakers will consider adding the COVID-19 vaccine to the mandatory vaccine schedule.

That means there are currently no personal belief exemptions for these vaccines, since they are not required in the first place. Currently, parents can choose to vaccinate their children against these diseases.

But if those vaccines are added to the state’s list of required vaccines, experts say an exception may not apply based on personal belief, depending on how new vaccines are added to the list.

Dorit Reiss, a UC Hastings law professor and member of the Vaccine Policy and Ethics Task Force, said the law includes a provision that allows the California Department of Public Health (CDPH) to order the vaccination bags.

If immunizations are added to the schedule in this way, the law provides that personal belief exemptions must be offered to parents and students.

“New vaccines that are required, like COVID, influenza, HPV, have a [personal belief exemption] if and only if they are added by the health department without going through the legislature,” Reiss said. “If they are added to the Legislature, the Legislature will set the terms.”

Exceptions And Deferrals

That means the state Legislature could choose to pass legislation adding a vaccine to the current list without providing a personal faith exemption.

“The Legislature may at any time amend or pass a new law to add a vaccination requirement,” said Brandon Stracener, a senior research associate at the UC Berkeley School of Law’s California Constitution Center. “This additional restriction on the department, an executive regulatory agency, reflects a balance between overreaction by agencies and the more direct accountability to voters that legislators face.”

SB 277 also includes a provision that protects some children with personal faith exemptions on file with their schools prior to the passage of the law. Stracener said those students are allowed to keep their exemptions until they enter a new “grade period” by transitioning from preschool to elementary or elementary to middle and high school.

“This temporary transitional protection applies to very few and ultimately no students in the developmental years,” Stacener said.

It’s unclear whether COVID-19 vaccines will be required for students in the future, but experts say they hope the legislature will take the lead if state officials seek to mandate them.

Reiss said that CDPH has not added its own vaccine to the list since SB 277 passed in 2015.

“I hope that if it’s added, it’s added to the legislature,” he said. “This is how all currently required vaccines are added. I think the CDPH is very wary of the political implications if it goes ahead without a legislative mandate.

“[CDPH] may try to consider the coronavirus as an eligible disease under these laws to require vaccination,” Stracener said. “But the legislature may have to answer for itself if a sufficient number of stated personal belief exceptions make it clear that the legislature must act to ensure public safety.”

Instagram posts being circulated by vaccine advocates claim that California will have a personal belief exemption for any new vaccines required after the passage of Senate Bill 277.

But experts say that’s not the whole story. The law includes a provision that gives the California Department of Public Health the ability to add required immunizations to the current schedule. For vaccines added in this way, the law provides that exceptions must be offered for personal beliefs.

The State Legislature may also add vaccines to the required list of immunizations. If a vaccine is added in this way, lawmakers can choose whether to include personal belief exceptions to the vaccine.

The posts further state that these exemptions apply to flu, HPV, and COVID-19 vaccines, though the vaccines have yet to be added to the state’s list of required vaccines.

It is unclear if the COVID-19 vaccine will be required for California students. If so, experts say they expect the Legislature to take the lead in mandating the vaccines and personal belief exemptions likely won’t apply.

In summary, there are currently no personal belief exemptions for any required vaccinations in California and there is only one process that would require personal belief exemptions to be offered for any new vaccine.
